LEBANON TOWN BOARD MEETING and BOARD OF REVIEW LEBANON TOWN OFFICES THURSDAY, May 27, 2010 5:30 pm to 8:25 pm MINUTES Members Present: Chair Lohny Fredrick, Supervisors Todd Wilson and LeRoy Tietz, Clerk Deborah Behl Pledge: The Pledge of Allegiance was recited. Public Notice: Clerk reported that Board of Review notices were posted on May 10, 2010 and agendas were posted on May 21, 2010. Preview Agenda: Agenda approved by consensus. Minutes & Treasurer’s Report: MOTION (Fredrick, Wilson): To dispense with the minutes and Treasurer’s report. Carried on voice vote. Resolution L-10-F: Zwieg Agricultural Conservation Easement: An explanation of the proposed agricultural conservation easement was given by Kyle Zwieg representing the Zwieg family. MOTION (Fredrick, Tietz): To adopt Resolution L-10-F the Lebanon Town Board favors and encourages a purchase of an agricultural conservation easement on the Zwieg Family farm in sections 24 and 25, Town of Lebanon. Vote taken: Lohny Fredrick – aye, Todd Wilson – aye, LeRoy Tietz – aye. Motion carried. Recess: The town board meeting was adjourned to the Board of Review at 6:00 pm. A brief recess was taken prior to the start of the board of review. Reconvened: The meeting of the Board of Review for the Town of Lebanon was called to order at 6:05 pm. Members present: Lohny Fredrick, Todd Wilson, LeRoy Tietz, and Clerk Deborah Behl. Chair/Vice-Chair: MOTION (Wilson, Tietz): To nominate Lohny Fredrick for Chair of Board of Review. Motion Carried. MOTION (Fredrick, Tietz): To nominate Todd Wilson for Vice-Chair. Motion Carried. Receipt of Roll: MOTION (Fredrick, Wilson): To approve receiving the assessment role from the assessor. 6:08 pm Case #1: Wilbur E. Schneider. The property owner resides at W3279 Crawfish Road, Ixonia. The address for the property in question is W3279 Crawfish Road, Ixonia. The tax key number for the property is 026-0916-3623-001. The property has been classified for assessment purposes as agricultural and a small area of undeveloped. Assessment Value is $8,600 for the land and no improvements. Chair stated that Mr. Schneider has three parcels in objection and that all parties would be sworn in only once for all three cases. Clerk swore in Wilbur E. Schneider as objector and Kyle J. Waters of Grota Appraisals, LLC, assessor. Testimony was taken on case #1. Deliberations followed. MOTION (Fredrick, Tietz): That, exercising its judgment and discretion, pursuant to Sec. 70.49 (9)(a), Wis. Statutes, the Board of Review hereby determines: the assessor’s valuation is incorrect and that the property owner has presented sufficient evidence to rebut the presumption of correctness granted by law to the assessor and that the 7.969 acres of undeveloped should be reclassified to 3rd grade tillable. Motion carried 4 to 0 on roll call vote: Fredrick – aye, Wilson – aye, Tietz – aye, Behl – aye. The total new assessed value on this parcel will be $4,200. 7:00 pm Case #2: Wilbur E. Schneider. Chair reminded all parties that they are still sworn in. The property owner resides at W3279 Crawfish Road, Ixonia. The address for the property in question is the same. The tax key number for the property is 026-0916-3513-000. The property has been classified for assessment purposes as undeveloped. Assessment Value is $5,500 for the land and no improvements. Testimony was taken on case #2. Deliberations followed. MOTION (Wilson, Tietz): That, exercising its judgment and discretion, pursuant to Sec. 70.49 (9)(a) Wis. Statutes, the Board of Review hereby determines that the Assessor’s valuation is correct and sustains the same valuation as set by the Assessor. Motion carried 4 to 0 on roll call vote: Fredrick – aye, Wilson – aye, Tietz – aye, Behl – aye. The assessed value on this parcel will remain at $5,500. 7:25 pm Case #3: Wilbur E. Schneider. The property owner resides at W3279 Crawfish Road, Ixonia. The address for the property in question is the same. The tax key number for the property is 026-0916-3511-000. The property has been classified for assessment purposes as some agricultural, some undeveloped, and a residential home site. Assessment Value is $113,100 for the land and $254,100 improvements for a total of $367,200. Chair reminded all parties that they are still sworn in. Testimony was taken on case #3. Deliberations followed. MOTION (Fredrick, Wilson): To go with Mr. Schneider’s objection that the property owner has presented sufficient evidence to rebut the presumption of correctness granted by law to the assessor and that on the 24.5 acres, the 25% positive land influence shall be removed. Motion carried 4 to 0 on role call vote: Fredrick – aye, Wilson – aye, Tietz – aye, Behl – aye. The total new assessed value on this parcel will be $109,400 on the land and $254,100 on the improvements for a new total of $363,500. 8:15 pm General Questions: Mr. Waters was asked by the Board about several properties that had improvements added during 2009. The tax exempt status was questioned of the former Specialty Cheese property #1712-005 that is now owned by Mr. Raether. The DOR will be called and Mr. Waters will mark this property for a special questionnaire when doing next year’s assessment. Adjournment: MOTION (Tietz, Fredrick): To adjourn at 8:25 pm.
