LEBANON TOWN BOARD MEETING
LEBANON TOWN OFFICES
WEDNESDAY, April 21, 2010 3:00 p.m. to 9:57 p.m.
MINUTES
Members Present: Chair Lohny Fredrick, Supervisors Todd Wilson and
LeRoy Tietz, Clerk Deborah Behl Joining at 7:15 pm was Treasurer
Jon Schoenike.
Pledge: The Pledge of Allegiance was recited.
Public Notice: Clerk reported that agendas were posted on April 16,
2010.
Public Comment: Wilson received complaints about disturbances on the
Highview Road River Bridge and about illegal dumping in the river at
the same site.
Preview Agenda: Agenda approved by consensus.
Minutes & Treasurer’s Report: MOTION: (Fredrick, Wilson) to dispense
with the minutes and Treasurer’s Report. Carried on voice vote.
Review and Approve per Diem and Expense Reports:
- Motion: (Fredrick, Wilson) to approve the expense report and one per
diem for Treasurer Jon Schoenike. Carried on voice vote.
- Motion: (Fredrick, Tietz) to approve the expense report and 12 per
diems for Clerk Deborah Behl. Carried on voice vote.
- Motion: (Fredrick, Wilson) to approve the expense reports for all
Board members and the per diems as follows: Fredrick 16, Wilson 12,
and Tietz 14. Carried on voice vote.
Recess to Annual Road Inspection: At 3:23 pm, meeting was recessed.
Town Board and Highway Superintendent Brent Boyd performed the annual
inspection of town roads. No official action was taken during this
time.
Reconvene Meeting: The meeting was reconvened at 7:07 pm. Treasurer
Jon Schoenike joined the meeting at 7:15 pm.
Opening of Sealed Highway Bids: Chair opened the bids and read them
into record:

Results of Annual Road Inspection: Chair reported that they drove and
inspected all the town roads. They also viewed the condition of the
trucks at the Town Shop.
Approve Contracts for Roadwork: Chair moved this item #11 to later in
the meeting after item #16 in order to give the Highway Superintendent
time to examine carefully all the bids. Those present were informed
all bids may not be awarded tonight because they need to be evaluated
against the budget or because some questions may need to be answered.
Those contracts not awarded tonight will be taken up at the May 6,
2010 Board Meeting.
Temporary Class “B” Picnic License: MOTION: (Fredrick, Tietz) to
approve a Temporary Class “B” Picnic License for Lebanon Fire
Department for May 2, 2010 Baseball Game at Lebanon Firemen’s Park for
the Baseball Concession Stand. Carried on voice vote.
Operator License: MOTION: (Frederick, Wilson) to approve Operator
License, pending satisfactory background check, for Michele Masullo
for the period ending June 30, 2010. Carried on voice vote.
Annual Weed Notice and Appoint Weed Commissioner: MOTION: (Tietz,
Wilson) to appoint Chairman Lohny Fredrick the 2010 Weed Commissioner.
Carried on voice vote with Fredrick abstaining. MOTION: (Fredrick,
Tietz) to approve publication of the annual weed notice with the City
of Watertown. Carried on voice vote.

Discussion on Outdoor Wood Burners and Burn Barrels: A lengthy
discussion was held on the proposed “Outdoor and Refuse Burning
Ordinance.” Discussion will be continued at the May 6th Board
meeting.
Approval of Revised Operator License Application Form: MOTION:
(Fredrick, Tietz) to approve the newly revised “Town of Lebanon
Operator’s License Application” form. Carried on voice vote.
Approve Contracts for Roadwork:
- MOTION: (Tietz, Fredrick) to approve contract with Payne & Dolan
Inc, Fitchburg for 2010 Special Project Cana Road in the amount of
$12,529.00. Carried on voice vote.
- MOTION: (Fredrick, Wilson) to approve contract with Payne & Dolan
Inc, Fitchburg for 2010 Special Project Poplar Grove Road in the
amount of $41,236.00. with the understanding that this project is
subject to a prevailing wage determination. Carried on voice vote.
- MOTION: (Fredrick, Tietz) to approve contract with Payne & Dolan
Inc, Fitchburg for 2010 Blacktop Bids in the amount of $49.45 for
overlay and $55.65 for wedging. Carried on voice vote.
- MOTION: (Tietz, Wilson) to approve contract with Crack Filling
Service Corp, Cross Plains for 2010 Crack Sealing Bids in the amount
of $1.00 per pound for crack filling. Carried on voice vote.
Future Agenda Items:
- Put Sealcoat bids on May 6 agenda to allow Brent more time to obtain
additional information from the contractors.
- Additional road signs for Poplar Grove and View Roads.
- Truck repair projects.
- Highview Road River Bridge disturbances and illegal dumping.
Additional Monthly Bills: Additional bills for the month were
reviewed. MOTION (Fredrick, Wilson) to pay bills, including already
approved per diems and officer expense reports, in the amount of
$20,525.50. Carried by voice vote.
